We believe that recent Board decisions have negatively impacted the community. The data from official records requests bears this out. It is important for the community to see the small faction of unit owners, property management businesses and board members who, in our opinion, benefit from the decisions the Board is making and how the larger community is impacted. We ask you to look at the data and draw your own conclusions.

Property Managers Stand to Benefit Most from Lawsuit
Many units suing Association appear to be affiliated with the same few property management companies - in addition to showing high guest card usage.
Unit owners, many of whom utilize three property management companies (Be My Guest, Live Miami and Juventino Santillan), have filed for legal arbitration against our Roney Association (meaning they are suing the owners of the Roney) to contest guest card fees. They allege that guest cards should be free.

The papers filed in this matter identify the units that are owned by the people/entities bringing the claims against the Roney. We believe that a review of the data clearly shows that a majority of these units have high guest card issuances, which are typically associated with illegal overnight rental activity. But again, review the data for yourself and draw your own conclusions.

Most Owners Follow the Rules and Do Not Exceed 20 Guest Cards Per Year
The majority of units do not exceed 20 free guest cards. Others have excessively high card usage and we are paying close attention to these units.
487 units (of 564) so not exceed their 20 free guests card allotment. This represents the majority of unit owners whose interests are being ignored by the Board.

Of note are the extremely high guest card users - high guest card use is a red flag for illegal overnight rentals. These numbers are consistent through 2024 as well - which again speaks to a pattern. If these high users are your neighbors and you see revolving guests and cleaning crews report the unit to Code Compliance with each new 'occupant'.

Note that reporting to Marquis at present is not worthwhile. They do not investigate or ask questions of suspicious guests as doing so would constitute harassment. While management is always within their rights to inquire about a guests' status or to request they sign affidavits attesting they are not renting for less than 30 days this Board has directed management not to institute any such measures to safeguard our community. ​

Board members chose to change the guest card fees rather than adhere to the tiered billing system. This undermines our 30 day minimum rental policy and removes a financial deterrent for illegal overnight rentals. The data shows that had the Board applied the longstanding rules, collectively they would owe the association over $100,000 per year. Review the data and draw your own conclusions.

In March 2024, it was revealed that our rules and regulations regarding the issuance and billing of guest cards were not being followed. The billing "error" for guest cards resulted in a loss of in excess of $1,000,000 for 2023. We believe that lack of enforcement of the guest card rules significantly contributes to illegal overnight rentals.

Forgone Guest Card Revenue In Excess of $1,000,000 for 2024
The calculable losses in 2023 data were repeated in 2024 to the financial detriment of the entire community. Again, data suggests that the bulk of the revenue would come from highest guest card users.
While there are many ways illegal overnight rentals are carried out, patterns of high guest card use ​is just one indicator for illegal overnight rental activity.

The Board declined to seize the opportunity in March of 2024 to correct the billing errors and realize a revenue of $1,000,000 for the Roney moving forward. Guest card data for the Board reveals a history of high card counts and personal financial benefit for themselves and a minority of unit owners with similar guest card usage.
While the Board benefiting from their actions is not a problem in and of itself, it becomes problematic when a majority of unit owners do not receive that same benefit - and instead incur a financial downside.
